Wills
It is important to keep your will up to date as it makes distributing your estate far easier for your beneficiaries in what is already a difficult time. There are many types of Will you can make. Apart from very simple Wills there are Wills with Trusts or Rights of Residence to mention a few. There are also traps to be avoided in making a Will so it is important to get good advice.
Letters of Administration
In the event that a valid will has not been left, Warland Solicitors can assist you with applying for Letters of Administration to the Supreme Court of NSW. In these circumstances, there is legislation that details how an estate may be distributed and by whom. An Application is required to be made to the Supreme Court for an Administrator to be appointed.
The Succession Act 2006
If you believe that you should have been included as a beneficiary in a will but have not been provided for, you may be able to make a claim against the estate under the Succession Act 2006. There are classes of person who can apply and you need to establish reasons as to why you should be considered a beneficiary of the deceased estate.
Probate
Warland Solicitors can help you apply to the Supreme Court of NSW for Probate in instances where there is a valid will and you have been nominated as Executor of that will. The Supreme Court can then grant probate which authorises you to distribute the deceased estate in accordance with the provisions of the will.
